The Appellate Division has upheld the High Court’s verdict that the oath-taking and formation process of the interim government are valid. On Thursday morning, a seven-member full bench led by Chief Justice Dr. Syed Refaat Ahmed dismissed the writ petitioner’s leave to appeal.
As a result, there was no longer any question about the constitutional legitimacy of the interim government formed under the leadership of Dr. Muhammad Yunus.
The date of the order was fixed today after the hearing on Wednesday. Attorney General Md. Asaduzzaman was present for the state. Advocate Mohsin Rashid was on behalf of the writ.
Advocate Shishir Monir, as an intervener in the hearing, argued, “People’s trust and acceptance are the fundamental basis of political legitimacy.”
In December last year, when a writ was filed challenging the oath of office of the interim government, the High Court dismissed it, saying that since the people have placed their trust in the government, there is no scope for questioning its legitimacy in court. The writ petitioner filed leave to appeal against that ruling.
In today’s ruling, the country’s highest court also maintained the same position.
